FAA Final Rule: Re-registration and renewal of aircraft registration

Summary of the Final Rule:
Effective from October 1, 2010, the FAA has announced a Final Rule that requires all civil aircraft with current N registrations to re-register. The Final Rule differs from past registration rules by imposing a 3-year expiration date on the registrations, as opposed to the past registrations that were issued for indefinite time periods. The FAA expects all aircraft to be in compliance within three years of the Final Rule's implementation.
Failure to re-register will make an aircraft unauthorized to operate, as there will no longer be a temporary authorisation option. This may further cause a breach of leasing agreements and insurance coverage. Registration numbers will also be cancelled if not properly reregistered, which will cause significant delays and costs such as applying for a new registration, repainting the aircraft, etc.
To comply, an aircraft owner must apply for the re-registration by submitting an AC form 8050-1A and a fee of $45 in a three-month ''window'' that is determined by the month of the original registration. Although the FAA will publish a timetable for the applicable re-registration dates, they will also notify preexisting registrants at 180 dans before the existing registration expires. The FAA suggests that all applications be made 90 days before expiry to ensure enough time to have a seamless registration. It should be emphasized that the burden to re-register is on the aircraft owner and lack of notification will not be considered a valid excuse for non-compliance.
